The Accords Betwixt Mysthaven and the Summerlands – first draft

The people of the Town of Mysthaven, and the people of the Faerie Realms known as The Summerlands, being desirous of a mutually beneficial coexistence, do hereby establish these accords in order that there might be an everlasting peace and understanding between our peoples.

Concerning the applicability of these accords: These accords shall apply to all residents of the Town of Mysthaven and all residents of the Summerlands. Visitors to these realms from outside shall be expected to abide by these accords, however neither Mysthaven nor Summerlands shall be held responsible for their actions unless said visitors have made themselves at home in either place and this placed themselves subject to the laws of that place.

Concerning the scope of these accords: These accords apply solely to the presence of the Town of Mysthaven within the Summerlands and to the relations between the people of Mysthaven and the people of the Summerlands. They do not replace or supersede the laws of Mysthaven or the laws of the Summerlands within those places and residents of either are bound by their own laws.

Concerning the precedence of these accords: The Laws of Mysthaven shall apply to the residents of Mysthaven within the boundaries of Mysthaven. The Laws of the Summerlands shall apply to the residents of the Summerlands within the boundaries of the Summerlands. These Accords shall apply to the interaction between the residents of Mysthaven and the residents of Summerland in either place. Local law shall have precedence save where these Accords deem behaviour harmful that are not considered harmful under local law. Within the designated neutral territory, these accords shall have precedence.

Concerning the sovereignty of the realms: The Town of Mysthaven shall have absolute sovereignty within its borders; save that no law or statute shall be passed that could adversely affect the Summerlands. Likewise, the Summerlands shall have absolute sovereignty within its territory save that no law or statue shall be passed that could adversely affect the Town of Mysthaven.

Concerning the territory of the Town of Mysthaven: That a portion of land on the edge of the Summerlands shall be set aside and designated as an independent territory for the Town of Mysthaven. Said land to be held by the Town of Mysthaven in perpetuity, or until these Accords are revoked or revised by mutual agreement.

Concerning the borders of the territories: The borders of Mysthaven shall be designated by agreed markers at the periphery currently marked by the roses. The area beyond that for a distance of 100 paces shall be considered neutral territory wherein both residents of Mysthaven and Summerlands may both freely enter.

Concerning mutual defence: Should attack come from without that would cause harm to Mysthaven and its residents and the Summerlands and its residents, then Mysthaven and the Summerlands shall act jointly and severally to defend both territories. Should attack come upon one territory only, then both may act to defend if so requested or the attack threatens the other territory.

Concerning the freedom of passage: Their Majesties, the King and Queen of the Summerlands, and their duly appointed emissaries shall have freedom of passage within the Town of Mysthaven without let or hindrance, save that they shall not enter a private residence or the castle without invitation. However, they shall pay due regard to the wishes of the ruler of Mysthaven and duly appointed officials should circumstances be that a visit is not convenient.

Other residents of the Summerlands may enter the town at their own risk, subject to permission being granted by town officials, which shall not be unreasonably withheld.

The rulers of Mysthaven and their duly appointed emissaries shall have freedom of passage within the Summerlands without let or hindrance, save that they shall not enter a private residence or the palaces without invitation. However, they shall pay due regard to the wishes of the rulers of the Summerlands and duly appointed officials should circumstances be that a visit is not convenient.

Other residents of Mysthaven may enter the Summerlands at their own risk, subject to permission being granted by local officials, which shall not be unreasonably withheld.

Residents of the Summerlands and Mysthaven shall both have full freedom of the neutral territory.

Concerning the Tribunal: In order that these Accords are able to be enforced and seen to be enforced, a Tribunal shall be established to oversee the implementation of these Accords. This Tribunal shall be made up of the Ruler of Mysthaven, the Chief Steward of Mysthaven, and the King and Queen of the Summerlands, plus one duly appointed representative from each territory. In the event that a member of the Tribunal is directly involved in the case being decided, then they shall recuse themselves, and be replaced by a deputy acceptable to the rest of the Tribunal.

The Tribunal shall meet regularly to discuss any issues arising since the last meeting, with a minimum of at least one representative from each territory. Decisions and judgements, however, shall require a minimum of at least two members from each territory. This meeting shall include any necessary review of the content of these accords.

This Tribunal shall rule on any amendments to these Accords.

It shall also decide all cases concerning breaches of these Accords, assign the necessary sanctions and oversee the implementations of said sanctions.

The Tribunal shall rule on any disputes, infractions and other difficulties arising between residents of the two territories. The Tribunal shall decide on any sanctions or punishment necessary. Said punishment or sanction shall usually be carried out by the appointed representatives of the offender’s home territory, unless deemed otherwise by the Tribunal, however, a representative of the other territory shall have the right to oversee the implementation of said punishment or sanction if required.

The Tribunal shall have no jurisdiction over purely domestic disputes, i.e. those that occur between residents of the same territory, save where such disputes might adversely affect the other territory or relations between the territories.

The Tribunal shall exact no sanction or punishment that results in permanent physical or mental harm or death, save for the most grievous of crimes, and then only after due process and all other avenues of punishment have been found wanting.

Concerning the Standards of Behaviour of Mysthaven Residents within the Summerlands:

It shall be the responsibility of the ruler of Mysthaven, or their duly appointed representative, with the assistance of duly appointed fae representatives to educate the residents of Mysthaven in respect of the nature, behaviour and predilections of the fae so that they are fully aware of the possible consequences of interacting with the fae.

Residents of Mysthaven visiting the Summerlands shall respect and obey the laws and customs of the Summerlands and the precepts of these accords and shall obey the reasonable requests of duly appointed officials of the Summerlands.

Visitors shall not attempt any harm, physical or otherwise upon any resident of the Summerlands.

Visitors shall treat all residents of the Summerlands with all due respect and politeness. In particular, members of the Royal Household shall be treated with due deference.

Visitors shall harm no structure nor animal nor plant save where foraging or hunting rights have been explicitly granted.

Visitors shall not enter any private residence, palace or official building save when explicitly invited or having a long-standing invitation to do so.

Visitors shall not approach the Throne Tree of the Summerlands save where explicitly invited of having a long-standing invitation to do so.

Visitors shall not profane or disturb such groves, pools, altars, circles and other places considered sacred by the fae, nor shall they approach such places unless specifically invited. Visitors approaching such places ignorant of their nature and with no ill intent shall be advised of the nature and allowed to leave without further sanction. Profaning or disturbing such places shall not be tolerated.

Visitors shall not bring items made of iron into the Summerlands, save for personal weapons for self-defence, which shall be kept sheathed at all times other than when needed for self-defence. This prohibition shall apply also to oatmeal and salt and other items considered offensive to the fae. Visitors shall not leave any items of this nature behind them when they leave the Summerlands.

Visitors shall be aware of, and prepared for, the consequences of placing any obligation upon fae residents by means of gifts, favours, gratitude etc.

Visitors shall be aware of, and prepared for, the consequences of any romantic or sexual liaisons with fae residents.

Visitors shall not capture any fae or demi-fae being in any form of enclosure, physical or magical, nor shall they attempt to forcibly remove any fae or demi-fae being from their realm. This rule shall not apply to duly appointed officers in the process of an authorised arrest, which should be carried out with the cooperation of the relevant fae officers.

Visitors shall not use trickery, bribery, deceit, magic of any sort or enchanted objects to entice the fae into behaviour that would otherwise be against their nature.

Concerning the obligations of the fae towards visitors: While it would be unreasonable to expect fae beings to act contrary to their nature, they should show due consideration to the possible consequences of their actions that might harm visitors, or harm relations between the Town of Mysthaven and the Summerlands. Visitors, providing they are acting reasonably, shall be treated as honoured guests. Visitors may be assumed to be knowledgeable about the ways of their hosts, nevertheless, they should be given ample warning and ample opportunity to refuse or retreat from any encounter that might prove, by their ways, to be to their detriment.

Concerning the Standards of Behaviour of Summerlands Residents within Mysthaven:

It shall be the responsibility of the rulers of the Summerlands, or their duly appointed representative, with the assistance of duly appointed representatives to educate the residents of the Summerlands in respect of the nature, behaviour and predilections of the residents of Mysthaven so that they are fully aware of the possible consequences of interacting with them.

Residents of the Summerlands visiting Mysthaven shall respect and obey the laws and customs of Mysthaven and the precepts of these accords and shall obey the reasonable requests of duly appointed officials of Mysthaven.

Fae visitors shall be aware of the effect of glamour, and their nature, upon the non-fae and shall endeavour to mitigate such effects as far as is possible in order to minimise the chances of residents being “elf-struck”. This shall especially apply to any dealings with young people and others not yet fully capable of recognising and dealing with such effects.

Visitors shall not attempt any harm, physical or otherwise upon any resident of Mysthaven.

Visitors shall treat all residents of Mysthaven with all due respect and politeness. In particular, members of the ruling Household shall be treated with due deference.

Visitors shall be aware of, and prepared for, the consequences of any romantic or sexual liaisons with Mysthaven residents.

This rule shall not apply to duly appointed officers in the process of an authorised arrest, which should be carried out with the cooperation of the relevant fae officers.

Visitors shall not use trickery, bribery, deceit, magic of any sort or enchanted objects to entice the residents into behaviour that would otherwise be against their nature.

Concerning the standards of behaviour while within the designated neutral territory: Where all residents of both the Summerlands and Mysthaven shall be expected to behave with decorum, politeness and respect as if both were guests of a third party. No harmful acts shall be perpetrated or attempted upon others. Magic, enchantment and glamour shall be permitted, with the agreement of other parties. Reasonable enticements to leave the neutral territory shall be permitted, provided due warning is given of possible consequences.

Concerning mutual trade: Exchange of goods and services between the territories; food, materials, manufactured items, enchanted items and physical, military, educational, magical and other services shall be treated as commercial transactions, and shall be conducted with honesty and fairness. Such transactions shall avoid the obligations pertaining to gifts and gratitude. This shall include individual transactions that would normally be deemed commercial, e.g. the engagement of a craftsman for services to an individual. Transactions of a personal nature are still subject to the appropriate laws and customs.
